PUBLIC OFFER AGREEMENT
for ordering, buying-selling, and delivery of goods

This agreement is an official and public offer from the Seller to conclude a purchase-sale contract for the Goods presented on the website sakralne.com.ua. This agreement is public, meaning under Article 633 of the Civil Code of Ukraine, its terms are the same for all buyers regardless of their status (individual, legal entity, individual entrepreneur) without giving preference to any buyer over another. By concluding this Agreement, the buyer fully accepts the terms and procedures for ordering, payment, delivery, return of goods, liability for dishonest ordering, and all other conditions of the contract. The agreement is considered concluded from the moment the “Confirm Order” button is clicked on the checkout page in the “Cart” section and the buyer receives electronic order confirmation from the Seller.

1. Definitions

1.1. Public Offer (hereinafter “Offer”) – a public proposal by the Seller addressed to an indefinite circle of persons to conclude a remote purchase-sale agreement for goods (hereinafter “Agreement”) on the terms contained in this Offer.
1.2. Goods or Service – the subject of the parties’ agreement selected by the buyer on the online store site and placed in the cart or already purchased remotely from the Seller.
1.3. Online Store – the Seller’s website at sakralne.store created for concluding retail and wholesale purchase-sale contracts based on the buyer’s familiarization with the product description offered by the Seller via the Internet.
1.4. Buyer – a legally capable individual over 18 years old who obtains information from the Seller, places orders for goods on the Online Store site for non-business purposes, or a legal entity or individual entrepreneur.
1.5. Seller – Individual Entrepreneur Rymar Anastasiia Oleksandrivna, established and operating under the laws of Ukraine.

2. Subject of the Agreement

2.1. The Seller undertakes to transfer ownership of the Goods to the Buyer, and the Buyer undertakes to pay for and accept the Goods under this Agreement.
2.2. The date of conclusion of this Offer Agreement (acceptance of the offer) and the moment of full and unconditional acceptance by the Buyer is considered the date when the Buyer fills out the order form on the Online Store site and receives electronic confirmation of the order from the Seller. If necessary, at the Buyer’s request, the Agreement may be executed in written form.

3. Order Placement

3.1. The Buyer independently places orders via the “Cart” form on the Online Store, or by email or phone number provided in the Contacts section.
3.2. The Seller has the right to refuse the order if the information provided by the Buyer is incomplete or suspicious.
3.3. When placing an order, the Buyer must provide:

• Full name;
• Delivery address (if applicable);
• Contact phone number.
  3.4. The name, quantity, SKU, and price of the selected Goods are indicated in the Buyer’s cart.
  3.5. Either party may request additional information; failure by the Buyer to provide it relieves the Seller of responsibility for quality of service.
  3.6. When ordering through the Seller’s operator, the Buyer must provide the information in 3.3–3.4.
  3.7. Acceptance of this Offer by the Buyer is done by entering data into the registration form or placing the order via operator. The Buyer’s data is recorded in the Seller’s database.
  3.8. The Buyer is responsible for the accuracy of information provided.
  3.9. By concluding the Agreement and accepting the Offer terms through ordering, the Buyer confirms:
  a) full awareness and acceptance of the Offer terms;
  b) consent to collection, processing, and transfer of personal data for the term of the Agreement and indefinitely after, including to third parties for order fulfillment; the Buyer is informed of their data protection rights under Ukrainian law.

4. Price and Delivery

4.1. Prices are set by the Seller and shown in UAH on the Online Store website.
4.2. Prices may change unilaterally depending on market conditions; however, once fully paid by the Buyer, the price for that unit cannot be changed.
4.3. Delivery cost is not included in the price and is paid by the Buyer directly to the chosen delivery service per their tariffs.
4.4. The Seller may indicate an estimated delivery cost upon Buyer’s request.
4.5. Payment obligations are fulfilled when funds are received on the Seller’s account.
4.6. Payment methods are listed in the “Payment and Delivery” section on the site.
4.7. Upon receipt, the Buyer must check the Goods for quality and quantity in the presence of the delivery representative.
4.8. By signing delivery documents, the Buyer confirms no claims on quantity, appearance, and completeness.
4.9. Ownership and risk transfer to the Buyer upon receipt in the delivery city or when handed over to delivery service.

5. Rights and Obligations

5.1. Seller obligations:

• Deliver Goods per Agreement and Buyer’s order;
• Keep Buyer’s private info confidential except as required by law or for order fulfillment.
  5.2. Seller rights:
• Unilaterally amend the Agreement and prices, effective upon publication on the website.
  5.3. Buyer obligations:
• Review terms, conditions, and prices before concluding the Agreement;
• Provide all necessary information for delivery and identification.

6. Return of Goods

6.1. Buyer may return non-food goods of proper quality within 14 days if unsatisfied by shape, size, color, etc., provided the goods are unused and in original condition with packaging and receipt. Exceptions are goods not subject to return under Ukrainian Cabinet regulations.
6.2. Refunds occur within 30 calendar days of Seller receiving the returned Goods.
6.3. Refunds are made via bank transfer to the Buyer’s account.
6.4. Return shipping is at the Buyer’s expense and not refunded.
6.5. If defects appear within the warranty period, the Buyer may claim remedies under the Ukrainian Consumer Protection Law.
6.6. Seller is not responsible for defects arising after delivery due to misuse, storage, third parties, or force majeure.
6.7. Buyer cannot return personalized goods made to order or that have unique specifications agreed by the Buyer.
6.8. Returns must be sent to the address listed in the “Contacts” section.

7. Liability

7.1. Seller is not liable for damages from improper installation, use, or storage of Goods.
7.2. Seller is not liable for failure to fulfill obligations due to false or incorrect Buyer information.
7.3. Both parties are liable under Ukrainian law and this Agreement.
7.4. Both parties are exempt from liability for failure due to force majeure (war, natural disasters, etc.) and must notify the other party promptly.

8. Confidentiality and Data Protection

8.1. By providing personal data, the Buyer consents to processing and use according to Ukrainian law without term limits.
8.2. The Seller commits to not disclose Buyer’s data except as legally required or for order fulfillment with contracted third parties.
8.3. Buyer is responsible for keeping their data current; Seller is not liable for issues caused by outdated or incorrect information.

9. Other Terms

9.1. This Agreement is governed by the laws of Ukraine.
9.2. Disputes are to be resolved through negotiation or, if unsuccessful, through Ukrainian courts.
9.3. The Seller may amend this Agreement unilaterally or by mutual agreement per law.
